If you do not request a Hearing within the time frame provided by the law, your right to a Hearing is irrevocably weighed. I have won many “un-winnable” cases with the DOL because the arresting officer failed to submit his report. Or some but not all of the police reports were filed. Or the arresting officer forgot to check key boxes within the police report that validate the Implied Consent Warnings. Or foundation was not properly established to justify the stop, detention and arrest within the four corners of the police report.
